Duct space inside the house of housing society

We had purchased 2 flats 40 years back and joined both the flats from outside. So the common duct has come inside the house. We had purchased the house on the condition that we are allowed to take the space in between. We have the written permission from the builder of the property permitting us to construct a single door in between the two flats. We have never stopped anyone from accessing the duct. Now the society is asking us to vacate the common duct area which is the common area of both flats. Are we allowed to keep that because we have permission from the builder ? And does this decision come under the purview of the society? And how protected are we legally?

Inheritance of property under pagdi rental system

This is in continuation to the explanation given by Advocate Mr Kalaiselvan on December 2022 regarding tenancy inheritance.

I have been residing at the current property as a tenant under pagdi system since last 50 years. The tenancy is on my father's name. However he expired about 14 years ago. Thereafter I intended to transfer the tenancy rights to my name. However the landlord has asked for a NOC from my sister for transfer of tenancy. My sister is married and has been residing in her marital home since nearly 30 years. I have been paying the rent since last 22 years.

My sister is now stating that to give NOC I should make her a co tenant so that she doesn't lose her rights on the property. Is this legally acceptable, as I understand that tenancy under pagdi cannot be willed as inheritance

Agriculture land issue 2024, sale deed

I had purchased a agriculture land of 2.5 acres in Nagdhar village, Narayankhed, Sangareddy district, Hyderabad, Telangana State dated 6th May 2023.

Mr.A sold land (Sale Deed -1st Party) to Mr. B.(Second buyer -4th April 2023)
CS sold agriculture land to Sai Prasad (3rd Party) .dated (6th May 2023)

Mr. A (1st party) not allowing me to enter into my land, instead threatening with my life, i have all call recording of Mr. A. Mr. B is not responding to calls nor sms or whats' up message. ? who's name should i file the case ? When police called for the initial discuss they replied to head constable that it is a civil matter why are you interfering in civil matter

How should i processed further, if i had to file a case on who's name should i raise complain or injunction or ejection order to be raised, how much time does it take to get resolve this matter in the court.

Registration of incoming and outgoing trustees

Dear Learned Experts

Greetings!

A charitable Trust having four trustees have decided to resign due to their personal reasons at a time. In place of them two new trustees have been inducted. Is it mandatory to register the outgoing trustees also or only incoming trustees should be registered with the sub-registrar office. Also the the new trustees desire to amend certain clauses to the trust deed.

Pleases suggest is it mandatory to have all the trustees who are outgoing and incoming trustees to be present for the amendment of the trust deed?

Poa and sale amount

The DULY REGISTERED POA has been given to a brother with 5 sisters all living in Tamil Nadu to sell their house after the death of their father. Can the POA receive the entire payment from the purchaser to his Bank Account and then give it to his other siblings ? Or should the sale deed be drafted accordingly to make the purchaser to pay it directly to all the siblings individually. Will the
1 %TDS deducted by the purchaser borne by the POA if done by him alone ? What is the correct procedure and what is the tax liability involved on all of them ?

Medical /metal unfit to sign

One of the adult married sibling mentioned in the unregistered family settlement has memory loss and right side physically paralised due to brain injury.but alive
.Query .how does one.get for the purpose mutation of shares of undiveded immovable property as per the mothers WILL which has to recorded in the municipal records.
The problem is the sibling concerned can not write nor put his thump impression under these medical condition how does the family get the mutation done./
