Whether children and husband of married daughter are members/ coparceners in huf of daughter’s father
Whether children and husband of married daughter are members/ coparceners in huf of daughter’s father after amendment (2005) in Hindu law 1956 and recently a decision of Hon’ble three judge bench of Supreme Court, Vineeta_Sharma_vs_Rakesh_Sharma_on_11_August,_2020 ?
I also sought the said guidance at https://www.lawyersclubindia.com/forum/details.asp?mod_id=14166&offset=2 about three months ago, but no guidance is given by anyone, so today I also sought the said guidelines at above thread, but It could not be submitted and reason was shown,
“Sorry your reply has been already posted. Please wait for someone else to reply first.”
So please guide,
With due respect to every expert sir, it is not a theoretical question paper, My father in law had an Huf, after his demise, My Husband became Karta, now He wants to take loans against shares Kept in Huf of My Father in law, the bank is asking the name of coparceners/members of Huf.

Can a commissioner appointed by court ask for a fees to make the valuation of deceased bank locker holder without nominee ?
There is no dispute between the legal heirs.

What does awaiting notice mean?I filled R.C.S. - Regular Civil Suit on 12-01-20 and it got registered on 18-01 but it showing case status as awaiting notice

Rcr by wife and she not returning back

Hello,

My wife left my home in 2018 along with my son.
Inspite of many attempts by me and relatives and neighbours she refused to come back.
No issues happened and she had just went to her mother's home for few days and didn't returned for no reason.
In 2019 she filed RCR and HMA24.
I responded to her petition that I am ready to stay with her and she should come back.
Then lockdown happened and now hearings have resumed.
I applied for mediation but she is not ready to attend mediation as well. She says she just need manintainence and doesn't wants to stay with me. She also doesn't allows to talk to my son.
She used to do job before marriage but left it after marriage and she is qualified but not working.

Please advise what to do.

Mutual divorce

my parents are seperated for 27 years but not divorced,last year we filed mutual divorce and didnot claim anything from my father,but on the hearing date he denied to appear and told us he will not come to hearing as he dont want divorce,and he also does not give any monetary benefits to us,i am his 27 year old only son and completely dependent on my mother,is there any way to make him pay for us??our lawyer told us if we go for contest divorce there is low probability that any fruitful thing will come

Deposition through virtual mode from usa under 13b(2)

My daughter has depose her statement through video-conferencing from USA. What is the ways she can be identified herself when in the order passed by honorable court on 23.12.2021 for deposition through VC on 12th Jan,21 has not mentioned anything. At present there is no walk-in access at Indian consulate.
What is the other alternative that can be adopted to satisfy or otherwise acceptable

Right on grandfather's property

My grandfather got his share of house from his father when he divided the house into 4 equal parts amongst his 4 sons ( including my grandfather).

My grandfather had a legal will where he had his 3 children on them ( 1 son, 2 daughters).
My mother being the eldest unfortunately passed away before him and my uncle and aunt forced him to sign off her share amongst them.

My grandfather passed away a few months later.
My question is do granddaughters and grandsons have a right over his property?
How could my uncle and aunt force him to distribute my mom's share amongst them?
If I file a case in the courts, do I have a strong case?

The Family Court granted divorce in husbands favour and wife filed a appeal in High Court .What is the status of parties when appeal is pending ? Can husband marry when appeal is pending ?Will it attract bigamy ?

Cancelled marriage before engagement by phone call.

I have cancelled my marriage before engagement by phone call. We have decided to marry each other before lockdown and after lockdown due to family misunderstanding, i have cancelled the marriage.

In this period, i havn't met her or spoke to her on phone. we just had a chat conversation and told her to do IT course.

On the next morning after informing them about the cancellation. They have come up with 40-50 people to beat me and my family. In addition, they have also damaged my house property and demanded for 10 lakhs Rupees.

At last, after the long debat, they have decided to take 3 lakhs Rupees as compensation as they are saying they have booked marriage hall and purchased cloths.

I lost my dignity and i am not able to digest this.

Please advice, what to do? Do i have to pay money to them or fight with them.

They are very dangerous and my house is nearer to their place.

If i have to pay, do i have to take any written statement as a proof.

Please give me suggestions. I am feeling helpless.

Ancestral property

My grandfather had purchased property he dead. My mother is the only daughter, has two sons,
My question is,
1. so eventually the property will be passed on to us.
2. she give the property to any one son
3. she sell the property and transfer the proceeds to a third person ?
