excution of decree

Dear All,


I am having a dicey situation where a decree holder after assignment of a decree to third party has taken application for excution of decree for possession, which is pending at Small causes cOurt maumbai. But after making the same he is not attending the court and is unavialble for futher procedding. Now the assignee of decree want to excute the decree for possession. But I jst want to know what will be the best option of the following 1. To continue the pending execution application by bringing the assignee on record,where we have to file rejoinder to the reply of the defendant to excute the decree( whether the deree holder after assignment of decree can make an application for Excution of the deree? What is the status of decree holder after assignment) If or 2. allow the excution application to get dismissed and apply for fresh execution of the decree in the name of assignee of decree?

In case where a property is owned by x's HUF (where X is karta), who will get the title of the property after X passes away?

POLICE CUSTODY FOR MORE THAN 24 HOURS

If an accused is detained in police custody for more than 24 hours without remanding to judicial custody, does it amount to illegal detention and bail becomes automatic for the accused? Any citation? Thanks in advance.

Right of daughter u/Hindu sucession act 1956

If in the self acquired property of father in year 1982 the father made partition deed of total land which is 5.5 acres between two sons ½ each? In the year 1983 father died after this the daughter demanded in the year 2002 filed a suit against the two sons and demanded the equal right within the property? Can daughter have a right after partition? Which law can be applicable? Plz give related judgment and case laws?

Whether PF is applicable to loading / unloading

Dear Experts

I want to know that whether loading/unloading from truck of textile goods are covered under EPF Act (loading /unloading are done by transporter only. )

settlement deed

my query to our learned brothers is that whether the settlement deed can be executed without specifying the extent of property settling like i am settling my 1/2 share in the property. i wish to know if there is any judgment to show that it can be done or cannot be.

Fate of my marriage

Ld counsels,

Mine is a six day marriage, wife is refusing for re-union. She filed a 420 case against me and demanding lot of money. I am shocked how such a money minded people entered into my life. My relation is demaged beyond retrieval which is mainly due to my father in law. I am not willing to pay her a penny and I am ready to fight the case for years. I have filed a RCR so that I record her reason for desertion and to show that I made my attempt for re-union. My question is irrespective of the outcome of RCR can I file divorce under the grounds of desertion after 2 years. I dont think she will change her mind anytime in the future, even at that time she will say she is not ready to live with me. Will divorce be granted atleast after 2 to 3 years. I am approaching court with clean hands that is no allegations of cruelty etc will be proved against me.

Auction by tender

Sir,
The Bank after proceeding under SARFAES Act 2002 invited Tender for sale of property. On the last day only one bid was recieved which was only Rs. 7 thousand above the reserve price. The action was confirmed. My question is that the bank was right on doing so because there was no competion and the price which is offered to the Bank is Less than the 50% of the present value of thye property.I have heard that atleast three tenders are mandetory but I cound'nt find the Citation or G.O.. Some one have the answer please reply its urgent.
