Lease

lease agreement permits mortgage of leasehold rights by lessee to third party with permission of lessors. Does lessors right to take loan on mortgage of the leased premises get affected by such right given to lessee. which shall be superior in law?

Non occupancy charges being added to my maintenance bill since the last two months

Respected Sir/ Madam,
I am residing in my mother's house since the last nine years with my husband and child in Panvel.My mother is staying with my sister in Chembur. Since the last two months our society committee has levied non occupancy charges on us. I asked them the reason and they are saying that a daughter cannot reside at her mother's house. The house has to be in my name. I found this reason very weird. I would like to know whether I have to pay the charges as per the housing society act which clearly states that such charges are not meant for daughters.
Seeking your legal advice in this matter urgently.

Rented property

Hi,
We have given a flat on rent in Jan 15 on an agreement of Rs50 stamp paper duly notarized for 11 months,but now i want to sell the flat i asked the tenant to vacant it in 1 month(Condition 11 in rent agreement - .That either of the parties shall give one month notice for the vacation of the tenanted premises.)but he refused and said he will vacant it after 11 months only.what proceedings we can do in this matter...
Property in U.P. (Delhi NCR)
Is this matter come under Delhi court or U.P. court(we have mentioned in the agreement condition that any matter in agreement comes under Delhi Jurisdiction)

Claim for daughter on my husband property

I am Shalini Jain from Delhi living separate from my husband since last 5 years. He didn't give us sum amount nor my daughter not for me.
Women cell instructed him give Rs.2000 for my daughter for every month but he give me few months.
Now he want to sell our flat in Mehrauli. But I want to save house for my daughter for her future.
Suggest me. What to do?

Can case u/s 340 crpc on enquiry stage when did ,restore or not ?

I filed application u/s 340 crpc,respondent appeared filed WS then I tendered affidavits
of applicants>The case was on cross examination of AWs on that day bar association observed no work day.One of applicant`s mother died.Clerk made oral request to Magistrate for adjournment on abovestated grounds but Judge D.I.D it.Now can this kind of case be restored or not,if restored under which provision.kindly guide me its very urgent.

Property matter

Sir,
My father had a joint property with his three brothers in village in delhi . My father expired in 2013 leaving behind three legal heirs. The partition of the said property is not possible . Can an application for appointing LIQUIDATOR/RECEIVER be filed in the court for sale / auction of the said property and proceeds be distributed among share holders / legal heirs accordingly . 2) does the court have powers to appoint liquidator/ receiver directly on the application/petition of one of the legal heir . The part of the property is in possession of my one uncle . Kindly advise . Thanks .

Divorce and child custody.. am scared and need help

Hello,
I am staying separate from my husband since almost 5 yrs now.
However, my daughter stays half day with me and half day with him as I am working.
Morning I send her off to school and after she is back from school at approx. 4 pm she goes to his house.. (he stays with my father-in-law).
I have now planned to file a divorce and legal custody case for my daughter.
I am sure he will create a lot of scene. As per the lawyer I have consulted, I should stop sending my daughter to his place once I file the case.
But I know he will create a lot of scene as he is not the guy who will take things hand down.
My maid is ready to take care of her once she is back from school.. till I come back from office.

What I want to know is:
1) What precautions/actions can I take before/at the time of filing the case so that he does not create any scene near my place or my office?
2) How can I stop him from forcibily taking my daughter with him if I am in office.. He might pick her from school/take her from my home?

I am really worried and have delayed filing my case due to all the threats he has been giving me incase I take our daughter away from him.
Please help.. :(

Fraud case

Dear sir,

I went to kabul four years back .initially i went on tourist visa later on extended the same there as work permit for 6 month as i was not feeling well there so i came back one of person from kabul is now threatining me that i have to pay him 5 lac rs else he will do complaint against me in kabul embassy and do case against me in kabul i have not taken any payment from him.he says he will do case against me by standing two persons who will say he has given me money where as i have no money with me when i came back to india now plz advice what i do as still i have no notice plz advice can he do case without any payment in my account or with no receipt or my signature of receipt.am in india from last four years and no contact with him either through phone or messenger or email.even before going to Kabul has no contact with him. plz help and guide.
