You could have lodged a police complaint about the missing file and saved your job. In such situations, the company can directly take action on your father in law if you give proof that it is in his possession.

Sir I think now its too late to lodge a complaint as the incident has occured in 2006. You should have lodged a complaint then itself as my friend said. Now you cannot proceed against him unless and until you produce a solid proof proving that your belongings are in his custody.

the only things i have " a complaint (which i made just after 6 days) agaist the car was taken away by him( father in law" but i did not mention the things and goods in the complaint, would this work?
Srinivas.B.S.S.T (Expert) 09 August 2008
Hmmm you can use it to a certain extent. But what is the status of that complaint. Has police filed their charge sheet in that or is it still pending investigation or the police referred/closed the same?
Shekhar (Querist) 11 August 2008
pls. let me know the direction through which i can reveiw the complaint, should i go to the police station and ask about the status of complaint? what is the way to file the chargesheet against him(father in law)?
Shekhar (Querist) 11 August 2008

1) do have obtained FIR copy of the complainat?
or

2) do have endorsement or NCR or C.mis given by the police?

Shekhar (Querist) 13 August 2008
as said earlier that there is only a complaint about the car that too he(father in law) took it not with free consent agreement with both the parties, so pls. suggest me!

and can i move to the Police station only for the purpose of forcefully possession of the car?. inquiry !

evidence i am having
1) a recorded forceful conversation of his with my father.

where he state that i can take the car any time from your house.

pls. advice all expert on this!

Forcefuly taking the possession is almost equal to theft. You can ask the SHO of the police station to disclose what steps they have taken on the complaint.

Srinivas.B.S.S.T (Expert) 18 August 2008

Thanks Sri, Can i ask for the inquiry under s. 378 ? so that the charge sheet or the transparency may come out !!!
Srinivas.B.S.S.T (Expert) 22 August 2008
you mean under the head theft but dont you think that the time span between the offence and your action is beyond reasonable explantion?
Shekhar (Querist) 22 August 2008
