Can an unregistered apartment association frame bye laws?

Generally laws are framed before registration of the Society.

There is a registered association with bye laws, but here we have a situation where the old body has resigned and a new body formed which is not registered and they have incorporated many changes in the bye laws which are not in the original bye laws.

So you have to file all the amendments made by society to the Registrar of Societies.

The new body is formed without any signatures of majority members, they formed the new body saying it was formed unanimously. Can the registrar office can still register it.

If the body is formed without following due procedure, move to Registrar of Societies. Changes in bye-laws has to be made in accordance with society act / rules and bye laws. If it is not done accordingly, move to Registrar for an injunction.

Registration of the society takes place and not of the office-bearers. If AGM or Special General House meeting of your society has elected the present office-bearers then they are right in taking any decision as per the bye-laws of the society failing which yo make a written complaint with the Registrar of the Societies of your area.

after registering the society under the act only the by laws are approved. Other than any rules or laws which can be treated as for time being to function the association , it can not be enforced legally if any dispute arise.
