Car parking charges on free space of the society

Hi, I have a query regarding car parking charges. I am a member of the CHS and have not purchased parking from the builder as it is illegal and I have been parking my car in free space of the society . Now the committee is proposing parking charges of R. 1000 p.m. for the cars parked in free space. Please provide your valuable guidance in this regard as it seems exorbitant and denial of basic right of member. Also the committee is not collecting parking charges from the stilt parking and open parking holder members. Is this valid.

Are you the only member charged with car parking in open space of the Society?
Is there any resolution adopted in GBM?
It would be advisable to consult a local prudent lawyer with relevant documents for appreciation of facts, guidance and proceeding.

Society has rights to frame the parking policy. If you are not satisfied with the society resolution you can challenge it before society registrar.

1. Society is entitled to recover "parking charges" as maybe passed in a GB meeting via a proper Notice-Agenda-Resolution.

2. However the above is applicable for all types of Parking (Open /Stilt /Podium /Rack etc....) There is no exemption for Stilt /Podium parking from parking charges. Charging Parking from "ONLY" open parking holders would be illegal & against the cooperative movement.
