property rights

(Querist) 20 July 2018 This query is : Resolved
Hi,
My maternal grandparents both hold property not self acquired and are still alive. They have 2 daughters and one son.One of them my mother is deceased and I am her only daughter. Can I claim my mother's share from my both grandparents? My uncle is denying me of any property share..

Since your father is also surviving LR of your mother (deceased) both of you may seek partition of the property through a local lawyer.

Sir, my concern is about my maternal grandmother's property which she has inherited from her father. My maternal uncle is declaring himself the sole owner of the property because my grandmother is with him. Can I claim any share out of it? ( The property is worth quite a lot as otherwise I wouldn't have dwelled into this matter) It is his brotherly duty to give his sisters some share but he is acting very inhumane and denying us any share.

Had she inherited the property through a registered partition or settlement deed?

Still your grandparents are alive. so if your mother inherited the property by way of partition or gift? If so, you will get share with other legal heirs of your mother.

You could not express the legal lacuna in your post, therefore, you should consult a local prudent lawyer for better appreciation of facts, analyse, guide and proceed.

Ok thank you all. I will consult a local lawyer and proceed further.
vidya (Querist) 22 July 2018
Ok thank you all. All I know is that the partition was through a fdp from court.
