(Querist) 28 June 2018 This query is : Resolved
Sir I have purchased in the year 2017 a house site basing on Encumbrance Certificate and Certified copy of Title deed (since originals were lost in cyclone). Now I have applied for loan from a Nationalised Bank. The Bank Authorities are insisting for Original Sale Deed of my seller (link document). Please tell me the solution. if with any decisions

Under the given circumstances a certified copy of the document certified by the Registrar of properties should be valid.

Submit an affidavit of the incident of loss of previous title document with the bank, file FIR of loss of document, publish an advertisement in news paper regarding loss of document , submit a certified copy of document to bank. It all requires use of discretion at the part of bank

You can take the help of legal counsel of the Bank (or) a lawyer of your region specialized on property matters to guide on the issue. One possible solution may be to ask the seller to provide you earlier loan details so that you can provide the same details to your banker. To avoid multiple mortgage bank may want to play safe.
