Salary not give after resignation

(Querist) 04 May 2018 This query is : Resolved
I was working at Macons Equipment Pvt. Ltd. , Ahemdabad , Gujrat from 15th june 2016 to 18th February 2017. As per company policy I followed one month notice period upto 18th february 2017. At the time of resignation HR department said they will give last two month salary after clearing F&F.

After one month notice period they give only relieving letter and told wait one month more for F&F clearing. After one month I try to contact by telephonic and by E-mail for my last two month salary but they not response.

In the mean time a customer lied that he gave me FORM-C , so company told me 1st you submit FORM-C then we will clear your F&F. Again I mail him if customer give me FORM-C, then told him (to customer ) for providing duplicate or receiving copy of that FORM-C but my company not reply me.

Please suggest me now what action I will do for this matter....????

Thanks

If customer has not given any C-form to you then what is the need for you to advise for submitting duplicate copy!

Vague and irrelevant posts by Mr. Kumar Doab, a fake expert with unreal name. You would be justified to question him for what specific purpose he needs such a huge personal & company information, when it is a simple matter of non payment of the notice period pay. There is no relevance in asking for any such information with reference to your problem. Mind it, any such information, if supplied to him can be misused to your disadvantage.

In this case, you'll simply need to send a legal notice to your employer for recovery of your salary, if he fails to repay within 15 days, you can proceed to file a complaint in labour or civil court.

Initially you are required to clarify that the customer company did not hand over FORM C to you, if you did not get it.
Even then if your salary / amount is retained issue legal notice followed by filing claim through appropriate court/ Tribunal engaging a local lawyer practicing service matters..

As suggested by many experts, you can issue a legal notice to the company after exhausting the remedy of writing to the top management seeking its intervention to clear your dues and make payment at the earliest.

You can demand all your dues including the arrears that you are to receive from the company in the said legal demand notice.

In case it fails to invoke any positive response, you may think about the option to approach an appropriate legal forum for recovery
