Car hit from behind

I had hit my car from behind to a bike,and due to fear I went away from the spot and the person was held with some minor scratches.he lodged a complain against me after 5 days,in the police station and the police visited at my house 5 days after the incident. After that the person came to meet me personally and started to ask me lots of money.I said I will pay the medical bill. But he was not listening for that. Now he has lodged a FIR against me in police station I visited the station and was granted bail.Now my problem is that due to some technical issue of the insurance company my car was not able to be insured during the time of incident.So can someone help me with, is this case punishable or will be left with fine.

It all depends what is mentioned in the FIR registered against you. The FIR and Charge sheet will be based on the medical report of the victim, if he received minor hurt or grievous hurt based on this medical report which is for t the charges under section 337, 338 IPC will be made. The charge shall also be u/s 279 IPC which is for Rash driving. All these are punishable offence with imprisonment and fine. The usual manner is settlement of dispute between parties and the court either put fine on the accused or dismisses the complaint case on the basis of lack of sufficient evidence for holding accused guilty. Driving vehicle without proper insurance documents can be result in paying fine for traffic challan.
