For marring my mausi's grandson

Guest (Querist) 29 December 2017 This query is : Resolved
I m in with love with a boy since 8 yrs and we both love each other. We want to marry each other. the problem is he is the grandson of my mothers's elder sister(my mausi) i.e he is son of my mausi's daughter.
Is there any way we can marry each other and can stay together?
Guest (Expert) 29 December 2017
How old are you, your mother, your mausi her grandson?
Guest (Querist) 29 December 2017
we both are of same age i.e. 22, my moms age is 54 and mausi's age is around 73 or 74
Guest (Expert) 29 December 2017
Good calculation. So far age of both of you is OK, as is marriageable. But the reason of difference of 20 years of age between your mausi and your mother is not understood. Any specific reason?
Guest (Querist) 29 December 2017
They are in total 5 sisters and 2 brothers. And the masui i m talkin about is eldest of all the brothers and sisters and my mother is the youngest one. besides this i don't knw any specific reason.
I want to knw if get married will our marriage be legal or not?

Guest (Querist) 29 December 2017
can anyone please suggest me something so that we can be together

Why pretend love instead of making clear that you want some specific clue for answer to your academic question?

However, if you have such a lust, why care for law? When you don't have any control, how law can be expected to control you?
Guest (Expert) 29 December 2017
Even otherwise, when you are anonymous, why any expert should be expected to advise you?

You may try to take help from some local lawyer.

Guest (Querist) 29 December 2017

A great debate on a hypothetical case. !

I can understand, when you know the meaning and the purpose of your query, why should you check from the dictionary. But, since you asked, I advised accordingly, as I am not a translation tutor for the law school students.

Unless there is a custom which supports such marriages such marriages are completely prohibited and void abinitio. No legal rights flow from it.

As suggested above, the marriage is void in terms of the provisions Section 11 of the Hindu Marriage Act (unless there is a custom to that effect in the community):

Section 11. Void marriages
Any marriage solemnised after the commencement of this Act shall be null and void and may, on a petition presented by either party thereto 1[against the other party], be so declared by a decree of nullity if it contravenes any one of the conditions specified in clauses (i), (iv) and (v) of section 5.

However, the marriage is null and void in a limited context in that the marriage could be declared void in a petition filed by either the husband or the wife, Other than this aspect there are no adverse consequences, civil or penal, upon you or the children.

As adult and major citizens, you have the freedom choose your life and no law stands in the way. It is only that law does not offer you the protection against each other, if one among you chooses to get the marriage declared void.
