Hindu member died intestate and also without making a nomination. No legal heir has come forward to claim right over property in response to society's notice for the same. Society has given undertaking to developer and received the corpus fund and flat ( for litigation, claim and damages). The society has suo moto acted as an administrator/ executor without obtaining any order from competent court. Under the circumstance is the action of society backed by any law. And further will the above be treated as a benami transaction and what is the time limit for treating a transaction as benami.
