Cheque bouncing case where part payment is made

Answering to the Query of Vikrant Karan dated 30.7.17

As I can read only Query but cannot reply I using this route please excuse Experts.

When the part amount of the Cheque is received of Cheque on which 38 case is filed,such case will not sustain unless
cheque carry endorsement as per section 56 of NI Act 1881.This is a definite answer.
