Double employment

(Querist) 12 June 2017 This query is : Resolved 
One of my friend is trouble in double employment where he is working in company x and he resigned from that company on date 06 apr 2017 with 3 month notice period.he have one offer from company y but issue is he has to join company y in 2 and half month.but company x is not ready to give release before 15 days.


1.can he work next 15 days in both company?
2.if company y HR is ok with this.then any issue will come in future in his career?


Please suggest on above issue.

1) Before completing notice period he can't join other company.
2) It depend up on his appointment TOR.

Suppose if he take 15 days leave without pay.then it is possible?because he dont want to lose new company offer either absond previous company.

There is no question of supposition. When in roll of any company, may he go on leave without pay, he would remain employee of that company.

How many persons are employed in it?
What is your designation and nature of duties?



How many persons report to you?



Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state?
Since how many months you are working?
Do standing orders (model/certified) apply to establishment and your designation?


Does appointment letter provide for notice pay in lieu of notice period?

Was ever any stinker, memo, show cause notice on any misconduct issued to you?


Are you a member of employee’s/trade unions?

Did you mention notice period of 3 months during interview, in employment application/form signed by you?

Has the next employer issued any offer letter?


Have you tried to get extension of 15 days from next employer!

Try to avoid such situation, do not join.

If possible purchase 15 days notice period and get early relieving.
