Refer the Dhanrajgiri Hospital Vs workman Case and Safdarjung Hospital Case.It all depends on the nature of service rendered.In the mentioned case the Hospital was mainly involved in Training the Staff Nurses and Other Staffs So it could not be treated as Charity Hospital.If it is Purely an Charitable Hospital for Poor Patients with out any charges to the Patients and with out any Payments to Doctors and Staffs it will not come under Industry Other wise it would be treated as Industry only as per Supreme Court.(Refer Bangalore Water Supply VS A.Rajappa Case Orders/Judgement in Supreme Court)

Doctors and other all staff like clerical, staff nurses, helpers, etc are paid employees and their PF, gratuity etc is also payable. Only treatment for patients with two days medicine is free and above two days medicine are required to be purchased from medical stores within the hospital. Whenever some dispute arises between employer and employee relief and case is filed before Labour court and in most cases as per advice of Expert Mr.NJS citation of Bangalore water supply is refereed by employee. But then also it is not understood that whenever another employee files cases employers states that charitable hospital is not Industry before the Labour court.

Case already filed before labour court. Employee in written statement have stated that charitable hospital not industry.

Treatment given to Patients is free but doctors and other staff are given salary, PF. Then this charitable hospital comes under the industry.
