Marrige by widow

Querist : Anonymous (Querist) 25 January 2010 This query is : Resolved 
One widower (around 55 years) having son and married daughter wants to marry with his relative who is widow (around 52 years)having two married daughter. That widow is also ready for the marrige but two daughters of that widow are not ready because caractor of that widower is not good and they wants to stop that marrige. How they can stop that marrige legally. Please help and advice.

As far as my knowledge goes, the marriage cannot be stopped as per law, as both are major in age and there is no restriction under law for remarriage. Only good and god can do it. Put in your best efforts. All the very best.

Dear Sir,
This is a very critical and complex matter in law as provided in the Hindu Marriage Act,according to which you can complain against the widower before the Registrar of Marriage but you would have to prove that the habit and intention of widower is against to you and your entity and it is also very important that a harmful criminal action might be possible if both the widower & widow will congragate them self.

they can't stop her marriage, which is intending to perform as per her will & wish.

If they are within prohibited degree they cannot remarry.Daughters of widow can file suit for permanent injunction against their mother and widower if the intentionof the widower to gallop the property in the hands of widow.

Experts are correct. No one can stop the marriage except themselves as both are majors and are willing to marry.

REGARDING THE REMARRIAGE OF WIDOR AND WIDOW KINDLY NOTE THAT
1.BOTH ARE MAJOR AND HENCE THEY CAN TAKE THEIR OWN DECISION.AND LAW WILL HELP THEM.CHILDREN OF BOTH PARTIES ARE LIVING THEIR OWN LIFE,THEN LET THE OLD LONELY PERSONS TAKE THEIR OWN DECISION AND ALSO LET THEM LIVE AND ENJOY THE COMPNY OF EACH OTHER .
2.AT THE TIME OF REGISTRATION OF SAID MARRIAGE A LEGAL NOTICE OF ONE MONTH WILL BE ISSUED ,AT THAT TIME IN CASE ANY ONE HAS ANY OBJECTION THEN THEY HAVE TO PRODUCE THE OBJECTION WITH SUFFICIENT DOCUMENTARY PROOF TO THE MARRIAGE REGISTRAR SO THAT REGISTRATION PROCEDURE WILL BE DELAYED AND THERE ARE CHANCES THAT THERE MAY BE CHANGE IN MIND OF BOTH THE PARTIES.AND THE PURPOSE WILL BE SERVED.
