My clients houses coming under submergence of a project v and compulsorily acquired by government. As rehabilitation centres I.e., providing house sites to the displaced persons whose houses are being submerged, the government is proposing to acquire irrigable dry lands very near to a tank

Govt. can acquire.

However, to find technical grounds for stay or otherwise all documents need to be referred, please discuss with some senior lawyer.

It is very difficult to find out any lacunae in such acquisition merely on the ground that the acquired land is situated near the tank.

If you may obtain a scientific study report from Ground Water-Cell to the effect that the underground water of that tank shall be harmful up to such and such distance then such action can definitely be stopped by getting it challenged either in high court by way of writ of certiorari or a suit for injunction.

When preliminary notification is done contest it. According to one land acquisition officer dont waste time with land acquisition office go to high court for quashing immediately this is proper and correct method. After award is declared rarely high court quash award of land acquisition
