Want to file a case against govt employe

I am a civil engineer, I have applied for engineer license in municipality Nirmal town
Adilabad district Telengana. I have gone through the orders issued by the Municipal
Administration and Urban Development Department  Andhra Pradesh Building Rules,
2012
MUNICIPAL ADMINISTRATION AND URBAN DEVELOPMENT (M) DEPARTMENT
G.O.Ms.No.168 Dated: 07.04.2012 in which requirement/eligibility criteria to get a
license is only possessing an engineer’s degree. The town planning officer is asking me to bring 5 years of experience certificate.
But the officer is fail to provide me the above said details
I have filed an RTI waiting for the reply.
If i found that this officer has misguided me and wasted my time and i have gone through mental trauma can i file a case against this officer in any means.

Certainly you can. The officer misguided an misled you. You can file a case against him for the mental trauma inflicted on you by the officer.

Do not go after the officer. it will yield no result.
Rather if the license is not getting issued even if you are eligible for this, you can file a writ petition to get necessary relief.
In the writ petition you can highlight the injustice done by the particular officer. The court may rap him at the time of heating.

Were i have to file a written petition in the police sation or in court. If i file a petition what will be the next step by the offical.does this act will effect me or my cereer or my profession.

Your career is not going to be spoiled merely if you raise the complaint against any erring person may he be an official or not.

You shall have to make a departmental complaint against such person.

Dear Furqhan Khan,

Your question is quite premature and irrelvant. You could have waited for the result of your RTI application based on which you could have asked your question.

Moreover, your cut & paste post reveals, as if you have posted merely an academic query and have not seen that GO by yourself. If seen, you seems to have read between the lines, as G.O. No.168 Dated: 07.04.2012, in itelf, does not provide any requirement/ eligibility criteria to get a license, as against your statement.

The GO, as endorsed to various authorities simply directs those authorities to read at least 16-17 further GOs dated back from the years 1998 to 2011 that contained Comprehensive Building Rules and other related rules which are applicable to Municipal Corporations, Municipalities, Nagar Panchayats and areas covered by Urban Development Authorities in the State.

So, won't you like to read those GOs before taking any action against the said officer and find out whether he has stated correctly or not?

Further, does not that reveals that your is not a real life problem, rather you put an academic question before the experts? By the way, what was your intention to post such an academic query?

However, if you feel that the said GO contains the eligibility criteria, you may place here the extract of the text containing the eligibility criteria, if included in the GO, as per your statement.

3. General Requirements for License:
3.1. Person who applies for license as a Builder shall be a graduate in Architecture or Civil
Engineering or in Construction Management or equivalent educational qualifications or 5 years of
experience as Class – II Civil Contractor.
To remind you i am a civil engineer.

Dear Furqhan Khan,

Thanks for your clarification. But, probably you are still reading between the lines. General requirements for licence as mentioned in Annexure IX, rferred by you, are applicable to builders and real estate companies, not for licence to civil engineers. Anexure-X was applicable to you and your application was required to be made in the prescribed form under that annexure, not as per Annexure-IX.

Please recheck, if your application covers the requirements of Annexure-X and application prescribed there under.
