Sinking fund charges

Our Society in Pune has 6 bldgs. and each bldg. had 2 flats at ground floor with garden and 2 top floor flats with terrace.
But these flat owners are not paying sinking fund for garden and terrace though at the time of purchase they paid one third cost per sq ft for the same.
Also garden and terrace is mentioned in their sale agreement.
Therefore, pls suggest whether Maharastra society by laws allows society committee to charge these flat owners for garden/terrace.

1. Flat area = 1000 square feet (as recorded in the registered Sale-Deed)

2. Sinking Fund can be charged ONLY on the "Flat area". All other areas are excluded, for purpose of Sinking Fund.
