Service matter

Hello all,
One of my friend named "A" was working as Assistant Professor on regular basis for 3 years in a College affiliated to Panjab University, Chandigarh. He has got a copy of appointment letter. However, his college didn't sign any contract of service with him at the time of appointment. One week back , all of a sudden he was relieved from job without assigning any reason. He want to file a case against college for being reinstated. Can he do so? If yes, which Forum should he approach n under what Law?

Teachers are not covered by the def. of 'Workman' as in ID Act.


You have not posted the service conditions applicable to him.



It is duty of the college to get the contract signed as advocated by the Univ.



The univ. takes this factor also into account for approvals.


It is felt that he may have to approach an able counsel specializing in service matters and Punjab and Haryana High Court at Chandigarh.

Your friend do not come within the ambit of workman hence he cannot avail the remedy available under Industrial disputes Act, however, he can definitely file a civil suit or a writ before Hon'ble High Court in this regard. Better advise your friend to meet personally.
