Heirship certificate

my wife and i together bought a flat in navi mumbai in 2010 and nominated our only son. my wife who was the first owner died in nov 2012.my son was taken as a nominee member only. i want my son to be a joint owner in place of my wife and should have all the rights an owner has. i also understand that now the maharashtra govt has waived off stamp duty if the property is transferred within blood relations. kindly let me know how this is going to help me and what i should do to get my sons name as joint owner and get name changed in cidco.

How many other LRs of your wife/yourself i.e., other than your son (nominee)?

Whether your wife died intestat or made/executed some WILL or any other document?

Appointment of your son as nominee do not create any right, title, interest or claim in the flat.

Consult a local lawyer for proper guidnace and proceeding.

The property being jointly owned by you and your deceased wife, the share of your deceased wife shall devolve on all her legal heirs, in your case it is you and your son alone.
under this situation, you may execute a registered release deed in favor your son relinquishing your rights in the share of the property that belonged to your deceased wife and after that you may execute a registered gift deed in your son's favor of the half property that lies on you.
Your son will become a proper owner of the entire property after that. Nomination will not confer your son the title to the property.
