Salary Not received even followed all company formalities...

Sir, My husband have resigned on 35.08.2015 after serving 4 years in a company. Therefore he have given almost 1 month notice, as mentioned in his appointment letter. Now, Company has hold his Salary.. also there was not any clause about salary after resignation.. my question is can any legal section available for holding salary after resignation. also want to know if company have not mentioned any clause about salary in the appointment letter then by legal how much time company can hold a salary.. if.. in the same case company have no right to hold a salary then what will be the legal procedure for same.. Please reply me as soon as possible we are very much in trouble...

You may write to good offices of appointing authority,MD,Chairman, narrating all previous representations (mention names/dates/brief minutes of discussion) and conclude that the pending dues (describe all details), documents e.g. acknowledgment/acceptance of resignation,FnF statement showing computation of all paybles e.g. earned wages/reimbursements/incentives/perks/allowances/leave encashment/bonus/LTA etc, service certificate,relieving letter,Form16,NOC/NDC,PF a/c slips of all years, salary slips of all months etc have not been supplied till date and demand to supply everything by Redg. so as to reach within say next.................7 days.



If good offices also do not provide any relief you may approach an able labor Law Consultant and proceed further under expert advise of your counsel.
