No agreement can dissolve the marriage. Only an order of court dissolving the marriage can break it.
So forget the agreement and insist on whether he has got decree of divorce or not.

An agreement to live separately from each other shall not be considered as divorce. A decree obtained through court dissolving the marriage by a decree of divorce only considered as a valid divorce.
Take an opinion from a local lawyer and then decide.
