false case of 304b/498a

Dear sir,my brother's wife commited suicide and died on 20th day after their marriage in june 2013.In laws complained it as dowry death.My parents and my brother were arrested and hadbeen in jail for 2months then.We never faced any thing like this,not even a single civil case.We dont want to roam around courts and so we are tryng for settlement.kindly help to solve this issue.

When your parents and brother have already been put in jail for the last two months, I wonder to know how you are taking the case lightly. Must hire service of some capable lawyer to contest the case, if not done so far, as case under sections 304b/498a should not be taken as an ordinary case.

When the case has already been initiated and your parents & brother have already been put in the jail, the case cannot be tried according to your wishes when you state, "we dont want to roam around courts." Your parents and brother will have to go to the court whenever date is fixed and to plead your case.

Defend the cases against your parents etc., no short cut.

Engage some good local lawyer and proceed.

Almost all accused never want to come to court / police station but law and procedure has to be followed for justice.

we hired a lawyer and we got bail.It all happened 2 years back.Since then monthly my family is going to court.

Sir,is there any possibility of tranfering case from one place to other place.Coz she committed suice in a place called Anantapur which is 1000km from our native place,where my brother used to reside.

No the case cannot be transferred according to the accused whims and fancies.Suicide after 20 days of marriage is registered as a suspicious death and that too in matrimonial home.Hence fight UR case on merits,if U have any,along with a capable,intelligent and a competent lawyer.

There is no shortcut to face this case. You may have to face the court for trial and challenge them on merits.
