Land acquisition

dear sir,
My house is situated adjacent to NH 37 in Assam. Recently NHAI has acquired land upto the entrance of my house for which my house may have no entrance and will face many problems like vehicular traffic and pollution because of adjacent to national highway which touches the steps of my house. is there any provision for compensation because this acquisition has made my house unsuitable for living.if they acquire my house i may get compensation for making a new house and leave that place.
your reply is highly solicited.

There could be a remedy if your house could be proved to be 'unlivable' before a competent judicial forum.

You may go thru the rules for compensation.


If acquired it might be average of 3 years of circle rate.


If it is unlivable then also you may go thru the precedences.


It might be an opportunity/blessing in disguise, also.


Get the property and its dimensions examined by some seasoned architect/developer and assessed if it can be converted to some commercial purpose sooner or later. Thus it may fetch you better returns.


In such situations all residents should preferably unite and find the best solution.

You will be adequately compensated by NHAI as per rules and prevailing rates, which you can challenge, if find inadequate.
Consult a local lawyer with all relevant records.

You can claim compensation if they have not paid.
