Pay protection from psu to central govt

Sir, myself Naveen.. I worked in PSU and later joined a cetral govt dept after clearing UPSC recruitment by selecion. My pay in PSU was greater than initial pay offered by Govt post. So I applied for pay protectiona according to OMs available in DOPT site. But the accounts officer rejected my request as UPSC did not specifically recommended for pay protection. Later they wrote for UPSC & DOPT for clarification and both are replied that I may be provided pay protection according to OMs. Still my accounts officer not satified as they used the word "MAY BE". He wants complete confirmation. What can I do? Can I get pay protecion according to the OMs or not? Please guide me. Can I challenge in CAT or Court. Please Guide.

If you applied for the post through proper channel for selection through UPSC, your claim is likely to be covered by the respective OMs. Before making sufficient background and evidence in your favour it may not be advisable to approach the CAT abruptly. So, it would be better if you get personal consultation from some service law expert by showing him all the case related documents and have appropriate guidance how to make your case sufficiently strong to hit the target. Otherwise waste of huge time and money cannot be overuled without strong background.

Thanku sir for ur reply......I applied through proper channel and technically resigmed from previous organisation. As per your suggestion I vl do necessary background work and documentation but still I cant understand why these accounts officers raise unnecessary queries eventhough they got clarifications fron UPSC and DOPT. Thank you for your advice.
