Succession certificate

my wife had taken loan from the bank she worked in and had purchased a two wheeler and a four wheeler. the two wheeler was registered at vashi rto whereas the four wheeler was registered at pen rto. after her death i approached the vashi rto and got the two wheeler registered in my name by submitting an affidavit and few other necessary papers. but when i approached pen rto to get the name transfered i have been asked to get a succession certificatee from the court. kindly advise how to get it and what will be the expenditure etc and how long will it take to get it.

@author, succession certificate may be obtained from the court of law of your jurisdiction. but legal heir certificate and death certificate are sufficient to transfer into your name. consult a local lawyer.

Try by submitting legal heir certificate, death certificate, affidavit and indemnity, no objection from all other legal heirs. Consult some local lawyer for exact procedure.

thank you for your reply. just for your information i do not have a legal heir certificate. i have her death certificate and i am prepared to furnish all other legal papers which can be obtained easily but they are stuck with succession certificate only my findings tell me getting one is a very difficult job. what i would request your good selves is to kindly let me know where to get a succession certificate from and what will be the expenses in getting one including lawyer fees.

You can apply for legal heir certificate from local tehsildar office.

Contact a local lawyer and file petition for Succession Certificate in the Court which comes under your area of jurisdiction. But it is not necessary. Death Certificate, Legal Heir certificate, and indemnity is enough.

For obtaining succession certificate you have to file a petition with the jurisdictional court seeking the succession certificate giving complete details of successors in interest either by adding them as co-petitioners or respondents, the court after conducting enquiry in trial, will decide the case to grant or reject the petition. Take the help of a local lawyer and proceed through him.
