Cancellation of sale deed

Guest (Querist) 15 May 2015 This query is : Resolved
Is cancellation of sale deed possible..?

My client purchased a land in 2014 bonafidely from Mr.A..and got it registered in his name..

Now through a civil suit my client comes to know that Mr.A has already sold the same land to Mr.B in 2010 and that document is also registered..

Now there is a compromise between my client and the first buyer i.e. Mr.B regarding the same land and he agreed that my client should keep the land..

Now is there any way that i could nullify the sale deed of 2010 and make the sale deed executed in favour of my client as genuine n bonafide..

Plz its an urgent matter..kindly help..

Yes, it is possible as:
1) the vendor has to get a "Cancellation Deed" of first vendee registered.
2) either of the vendee may move to the court for declaration of the sale deed qua first vendee, as "null and void"

Mr. Karan,

Are you really a PP, as per your profile?

If a PP, how that happens that you have your private clients?

Secondly, If you are a PP, you should know the procedure.

Your asking to "explain the whole procedure for guidance, indicates as if you are a student and have prepared a false profile in the guisse of a PP. WHAT YOU HAVE TO SAY ABOUT IT?

Mr. Karan,

Instead of repeating your query, you could better have replied my queries.

No sir i am not a PP..there might be some mistake or error..i am an advocate with one year of experience..
Guest (Expert) 17 May 2015
Mr. Karan Kapoor,

So, by saying, "i am not a PP..there might be some mistake or error..i am an advocate," you want to prove me wrong.

VERY SMART MOVE BY AMENDING YOUR PROFILE AND THEN SAYING I AM NOT PP, WHILE I POSTED MY OBSERVATION ONLY AFTER CHECKING YOUR PROFILE. Evidently, on my question, "if a PP, how that happens that you have your private clients," you were compelled to modify your profile.

PEOPLE DESIROUS OF SEEKING HELP SHOULD NOT TRY TO BE OVERSMART.

Anyway, even if you are an advocate, still if you ask for the WHOLE procedure for guidance, that clearly reveals you don' know even ABC of the court procedure. AO, WHY DON'T YOU ADMIT THAT YOU ARE JUST A LAW STUDENT AND WANT TO SOLVE YOUR ACADEMIC EXERCISE?

It may be noted that the same query was posted a day before in the name of an author by name Paras Gupta and the same was very properly addressed by many experts, now this author is coming out afresh with the same query under a different name and questioning the experts despite being advised properly. Seems to be more of an academic nature than a real problem discussed.
