Theft

(Querist) 03 April 2015 This query is : Resolved
Hello Sir/Madam,

I have recently faced a theft in my hostel room.
The items that have taken away are my mobile phone, laptop and a bag with some stationary item in it.
I have a CCTV footage recording of the theft.
I have lodged a complaint against it ion police station ,they make there inquiry and after all the things they denied me to lodge an FIR against it;even though I have provided them with the video footage.

I have all the bills for mobile phone and laptop.

Can you please suggest me what I can actions I can take to get my complaint lodged as an FIR.

Regards

Academic query. If it is a real problem, approach the principal of your institute or the hostel warden for taking necessary action.

if local police station is refusing to lodge complaint you can address letter to commr of police regarding police refusal to lodge FIR

you can also file complaint under section 156(3) to direct cops to investigate and submit report .

Sethi ji,

The querist has not given any reason for refusal of the police to register his complaint. If he was living in a hostel, naturally he can be a student. That clearly indicates that he simply wanted to get his academic query solved.

If FIR is refused, file complaint before the Magistrate u/s 156(3).

Yes, it appears so.
Anyway meet a local lawyer who will tell you what to do in this situation when Police refuses to act on complaint.

Dear Harsh,

You have still avoided to quote the reason offered by the police in refusal to register a complaint.

Even if you are living in a working men's hostel, that is the liability of the owner of the hostel and the security guard to get the matter investigated. Their involvement is a must in lodging the FIR.

Hello Dhingra Sir,

Thank you for your valuable guidance.
The refusal that police has given me that they lodge an FIR for theft only if there is any physical evidence like breaking of lock or tempered window bars .
But in my case I have no such evidence.

I ask them that i have provided police with the video footage from CCTV ;they just ask me that they will try to track my mobile phone but cant lodge an FIR.
