insurance policy

i have a passengers carrying vehicle with permit, registered with rto office as such since 2002 and insurance policy also for commercial vehicle but the insurance company changed the last policy as private vehicle and in this period of policy accident occurred, can insurance com. changed the policy without changing in the RC

Ins., co., cannot change the policy, it is mistake of the ins., co., issue notice to them and claim the compensation for their illegal act.

Question at this stage shall arise-why you were not vigilant at the time when the policy for the current year was issued in your favour and why didn't you made any representation/legal notice at that time and why you are adopting all these measures at the time when accident has occurred and some persons/passengers/third party have sustained injuries?

One conclusion may also be arrived that the insurance charges on private vehicle are very less than the passengers vehicle and to save that excess amount, you bought only private vehicle policy and thus insurance company is not liable to the consequences.

This is just the other probability. This is not definite whether this had happened but this is also a point which insurance company may raise. You go in depth whether an error has been made or this is the reality.
