(Querist) 19 November 2014 This query is : Resolved
hi to all, a suit filed against me and for that i appoint an advocate. he is not attentded to the court matters for that the court ordered me as an exparte and call for the other for exparte evidence. during this i gave an vakalth to another advocate but the court didnot accept that and rejected that for no objection from my previous counsel. previous counsel is not ready to give no objection and he is from different place what should i do? is there any provision to file the vakalath on behalf of me for the new advocate.

send letter by regd post Ad to your advocate that you do no wish to retain his services any more . you have to apply before registry for discharge of advocate . furnish copy of letter sent by regd post Ad and acknowledgement . if notice has been received by advocate registrar will permit his discharge . you can then engage another advocate

The procedures differs in court to court.
The most convenient would be to get NOC on a vakalatnanma to engage a new advocate.
If this fails then follow the advice stated above.
