SUBLET OF ROOM

(Querist) 17 November 2014 This query is : Resolved 
One of my tenant has sublet his room to an unknown person. the rent bill which I give to the tenant on the foot note is printed that tenant has no right to sublet, transfer or assign set apart his tenancy or any part thereof. My query is that can I issue notice and file an enjectment suit against said tenant ?

However, it is to be noted that your agreement also states the same i.e. "tenant has no right to sublet, transfer or assign set apart his tenancy or any part thereof"

If the tenant is found to have violated the condition and terms of tenancy, you may very well issue an eviction notice to him stating the grounds and breach of the conditions asking him to vacate the premise for this gross violation, failing to invoke any response to this notice, you may go ahead with an eviction suit through court.
