Wrongful death

(Querist) 10 August 2014 This query is : Resolved 
 
Dear Experts: My mother aged 80 years was allowed to take a trip to Kailash- INDIA (place of pilgrimage) and she died during her travel.I researched and found that Visas are issued after stringent scrutiny. I want to file a case against the travel agent,the doctor who to my belief have circumvented all rules to allow her to go .Please advise how best to proceed. Many thanks,

Dear Author,

I am sorry about sad demise of your mother.

Your matter falls under Consumer Protection Act and hence you can file the complaint under the same.

Before proceeding further, you required all the papers which you have submitted to department for visa/permit procedure and with this gather medical/treatment papers of your mother if any.

Only after detailed analyzing such papers, I can further guide about probability of success.

Apart from legal aspect, If such permit not issued to your mother and not allowed to visit, which might be a life dream of your mother in such condition what could be your mother's stack.

If you seem that any offense is made out, The family members going with your mother and the family members who let her go to this pilgrim are equally liable for punishment.

So leave the doctors, they are very far, check culprits near about you.

No doubt a consumer case may be contemplated, but analyse the facts of what and where things went wrong and who are all responsible for this loss, may be you people should have thought about it before sending her on this strenuous pilgrimage, introspection is essential before contemplating a legal recourse.
