I have conducted one inquiry in one company .Thereafter on the basis of inquiry report managment has dissmissed the deliquent workman and workman has raised indusrtial dispute under I.D Act& matter refered to labour court for adjudication .Now my question is whether can i appear as an advocate on behalf company in court?

No. You cannot appear in the similar case either on behalf of any party in which you had conducted an enquiry.

The decision of the company must have been based on your enquiry report and in suit the same is challenged.As an IO you were judge and so you have knowledge of facts of both the parties, and so as Mr.Makkadsir says, you cannot appear on behalf of any party.

As a prudent person and ethical professional, you are not supposed to appear on behalf of the company. The code of ethics prevents you from doing this.
