Fir lodged against 2 wheeler

Hello Experts, On Feb 2014 I met with an accident with 2 wheeler while I was driving in 4 wheeler along with my family.
The impact was too much on my 4 wheeler, the 2 wheeler guy have got few scratches. I have lodged a complaint against the 2 wheeler as I need to claim for my insurance. I was told by the police that once the 2 wheeler guy comes after his treatment, he will be attending the court and minimal charges he will need to pay to get the FIR closed.
Now, after 5 months when I called the police to check the status of the FIR, he says that the 2 wheeler guy is opposing his fault and the court will send the summons to you and you have to attend the court.
Now what I am suppose to do, should I wait until the court summons come to me.
Will there be any possibility to withdraw this case as I am not expecting any money from the 2 wheeler guy.
