Unpaid salary

Dear sir,
please guide me how i can recover my salary
and dues from company where still working and
unpaid since last 3 month

If you want to continue in the company then get it settled amicably. Otherwise legal recourse is only option by way of both civil and criminal jurisprudence.

Pursue through written humble representation/ reminders, otherwise on legal notice the management may get offended resulting in to your termination on any fake charge. The formal representation/ reminders can also be helpful to make your case legally sound, even if they try to shunt you out of the company on any fake ground.

The employer is unworthy of being employed with.
You would be compounding your loss, financial burden, woes by continuing with it.
Firm up your next venture AS AP.

Submit to the point, precise, concise, written communications under proper acknowledgment, addressed to reporting authority, appointing authority, MD, Chairman and highlight that you have been reminding in office to Mr/Ms………..designation…………………..for payment of unpaid wages of months of…………………..and same are not paid as on date……………………..due to which you have suffered acute financial difficulties, and request to supply the payment immediately.

Follow up in writing of course under proper acknowledgment.

While you decide to leave conclude that you are unable to meet the expenses to attend o even office……………………. and clauses on notice period/pay has lost its sanctity due to breach by employer.

Otherwise the employer shall be pleased to square off the dues by adjusting notice pay.

BY the awy it is you alone or all employees are not being paid?
If it is you alone then Why you are alone?

Assuming that if your notice period is 3 months then employer has already made you work for free for 3 months………………….

If all employees are not being paid then all employees together (even you alone even an anonymous ) the employees may lodge complaint with ‘Works Committee’, Employees Unions, Trade Unions, Inspector under Payment of Wages Act, O/o Labor Commissioner, Inspector under Shops and Commercial Establishments Act…………..(if it is an establishment covered by the Act).
