Mahila court

(Querist) 28 May 2014 This query is : Resolved
The case is of IPC u/s 354, 509, 34.

Case is under trial in H'Court.
MM has kept the case on Order for charges in next hearing.

Accused in this case has also given threat of putting the house of Complainant on fire with help of local Gundas and the same is mentioned in FIR as well as in 161 CrPC. And Complainant had also written Complaint to Comm. of Police at that time.

Now, MM is not of opinon of including the IPC charge for this offence in addition to already 3 charges.

I kindly request the experts for their opinon by which Complainat counsel can emphasise H'Court for considering the charge for this Offence aswell.

Thanking you in anticipation.

Dear Querist
the complainant counsel should argue the matter on charge with sc/hc judgments in which the court held regarding the add additional sections at the time of framing the charge. if the MM is satisfied with the argument and Judgments of SC/HC then MM may add additional charge other wise the complainant may file a revision petition before session court or HC as she think fit.

If MM decides against filing revision is the way left. Agree with the advise of expert.
