Transfer of property in case of divorce

(Querist) 13 January 2014 This query is : Resolved
My husband and I jointly own a residential property in Delhi in the following proportion:
Me - 50%
Husband - 25%
Father in law - 25%
My husband and I are getting divorced and as part of the settlement he and his father have agreed to transfer their respective share in my favour.
I wanted to understand from you what is the best way to transfer (relinquishment / partition / release deed??) so that the transfer is irrevocable and also stamp duty and registration implication is minimal.
S.QAISAR ALI ADV. (Expert) 13 January 2014
the best option is sale deed, though according to settlement an agreement can also be performed.

Gift deed or sale deed is irrevocable but stamp duty has to be paid.
T. Kalaiselvan, Advocate (Expert) 14 January 2014
Release deed or settlement deed will attract lesser stamp duty value, why do you go for partition?
