Condonation of delay

(Querist) 07 January 2014 This query is : Resolved 
dear sir,
police filed condone delay for a period of 481 days in one bench in high court on acquittal, later petitioner/ COMPLAINANT filed condone delay for a period of 731 days in different bench in same high court. petitioner/ COMPLAINANT and respondent/ ACCUSED are same in both the cases and the appeal is on acquittal with a delay of the above.THE CASE CAME UP FOR HEARING I.E. filed by petitioner 731 DAYS, but the case filed by the police did not come for hearing. NOW WHETHER THE (RESPONDENT/ACCUSED) HAVE TO FILE ONLY OBJECTIONS TO CONDONE DELAY OR OBJECTION ALONG WITH COUNTER APPEAL GROUNDS , plz explain?
CAN ANYONE SEND JUDGMENTS ON NOT TO CONDONE DELAY ON ACQUITTAL.
HELP ME.
