Parking rights in a co-operative housing society

(Querist) 01 January 2014 This query is : Resolved
Hon. Experts,

In a CHS if the members of the managing committee do not pay heed to:

[1] the order of the Hon'ble Bombay High Court, that "builder can not sell parking space,"

[2] as also do not abide by the parking rules of the CHS law, and do not allow me to park my vehicle in the compound of the society building, telling me that I can not park my car inside the compound as I have not purchased the parking space from the builder, what authorities should be approached?

I shall thank you for your valuable guidance.

you will have to move cooperative court against society .
how many parking slots are available in society and how many members are there in society . if more members then parking has to be by drawing of lots as provided in bye laws

You can move to cooperative court for relief.

Yes the Cooperative court may be approached for proper relief, but before that why dont you issue a legal notice to the builder about the issue and take his reply also to the court seeking the subject relief accordingly.

Hon. Experts,

I have come across a recent judgment of Hon. Additional Consumer District Forum at Bandra Mumbai in Consumer Complaint no.164 of 2011, that CHS member is a consumer, can I approach the Hon.Consumer Forum with my problem?

Please enlighten and oblige.
