a person seeks loan from bank on the basis of sale deed which take effect and mutation was done by revenue authorities and produce all document required by the nationalized bank thereafter search report prepared by the advocate and some objection was raised. the sale deed required some correction then person produced registered modification in sale deed thereafter he required consent of all person who legal heirs of executors of said sale deed. thereafter the person notarized the consent affidavit by all person but bank and advocate of bank not satisfy with notarized documents. now question is that what is a legal value of notarized consent affidavit.

Notiarised consent affidavit in this case has no value.
Get those made as conforming party in the deed of sale.

The Rectification Deed has to be executed in the Registrar Office.This Corrections required by Banker's Advocate would be essential not only for Bank Loan but for the Validity of Documents itself.That is the reason it is taken for granted that any documents which had availed a Bank Loan supposed to be perfect.

The facts are not clear. The registered modification deed is signed by the seller or not ? If yes, whether the property purchased was ancestral in which the consent of others was required ?

The objection of bank should be rectified, it would be better for free marketable title of the property.

As per the Querist there is no registered modification deed.It is only Notarised.
