if you are not ready to go to court then execute a familly settlement deed with your tau ji and settle the matter amicably.

If both of you are agreed to settle the properties in an amicable way, better to partition the property as you both wish and will, if any discrepancies in partition the property, go to the court and file a partition suit. The choice is yours.

Even if a mutual settlement is arrived at, better to get it converted as a decree of the court so as to settle all issues permanently connected with the property partition. A Court decree is binding for all.
