GIFT THROUGH POWER OF ATTORNEY

The case where the property of my parents were sold and they gifted us the money and we bought the property from that fund, then if I have gifted it back to my mother through valid power of attorney because of my wife's wrong behaviour and then filing for divorce, then what is the status.

Now, when your wife have executed POA in your favour then, after the gift deed the property belongs to your mother. However, POA can be challanged by your wife.

Gift through power of attorney, if not specifically mentioned in the gift-deed cannot be made by POA holder.

If your wife have executed POA in your favour and after that you gift the property to your mother on the befalf of that POA, then your wife can challanged that POA.
