Not mutated

(Querist) 20 October 2013 This query is : Resolved 
my friend purchased the land,which was registered since 15 years back he was not mutated the said land .
1.now the vendor trying to file civil suit based on the mutation record,to harass my friend .will the vendor succeed in the case.
2.in the EC STATEMENT vendor'S name was mistaken ,(in sale deed orginal name is narshima chary but in EC narshima reddy)which creates any problem sir.
3.original sale deed has no mistakes,at this stage what steps i have to be taken in the hon'ble court.
pls give me suggestion and mutation related case laws .

The time to file mutation based on a sale deed has expired.Why your friend learned to sleep even more than KUMBHKARAN?

Now only declaratory suit is the remedy at either side.

1. If sale deed is properly executed then vendor would not succeed. Mutation is not proof title.
2.Yes, he would try take advantage of it,
3. Take possession of the property if you have not taken in the meantime. Apply for mutation also.

You now need to file a civil suit for declaration and should seek the decree of the court in this regard.
