Partition suit pending

partition suit is pending in the court,my fathers big brother is planning to make a WILL of his share of 2 acres of land to his Daughter AND HIS WIFE,because his wife has filed a case for monthly compensation,they r not living together past from 45yrs,my father brother has not having money to file a case against her wife,he his aged about 82 yrs,plz advice what will be the feature for the partition suit,weather my father &last brother will get their share of 2acers each,total land is 6 acres,all the 6acers is in the big brothers name who is going to make a will now.
