Land Acquisition ACT 1984

Land was acquired by Himachal Pradesh Govt for the ONGC in 1995, The notification was issued, the objections were filed thereafter since 1998 there has been no further hearing, the award has also not been announced by the District Collector. The land is in possession of ONGC (it was in their possession as tenants at the time of notification also). They are not paying rent since 1999 and nor has the land been vacated. Has the land acquisition become infructous and what steps should be taken to get ONGC to pay the previous rental and vacate the land.

Land acquisition has not become infructous merely on the ground that neither rent has been paid nor award has been decided and further land has not been vacated. Land has been acquired, it is a closed chapter. Now question remains only qua the award and its payment. You should insist to the collector to decide the matter urgently and if u fail to do so, approach Hon'ble High Court who shall direct the collector to decide the matter within the stipulated time.

Meet ur local Advocate tell him the details of acquisition of land, L A O order will be there, if the award issued by the L.A.O is far less then the market value of the land then, approch court for higher compensation claim amount by filing LAC case.

Also if time limitation is exceeded then u can file the application along with an affidavit for delay condonation under section 5 of limitation act.
