My wife's sudden departure to father's house and no sign of return

(Querist) 08 June 2013 This query is : Resolved
My wife suddennly departed to her parents place along with all her belongings, ornaments and my daughter on 01/04/2013 following an acute wrangle and hot arguments with me on 31/03/2013. She left my house when i was in office.I have intimated the case to the local police station. In April and May i have sent her rs 8000/- per month through money order and that she has accepted. i have tried my best to persuade her by my self, by well wishers and mediators etc. but she has refused to come. As per ajoy sir , i wrote her letter also which she did not reply. She is asking for a mutual divorce at the cost of 30 lac or she can come back if i purchase a flat. both the things i denied as per the advices from the experts like ajoy sir, ravinder sir and others. However my wife is not interested to return. should i keep on sending her money and if so for how long.
She has not filed any case against me till now.if i stop giving her money and force her to file case against me should i get advantage as a defendant. please advice.

Wait some more time say six months and it is hoped that the situation would improve. If the proposed flat is to be taken in your name and you are in a position to purchase it, you may proceed provided other factors support. If flat is to be purchased in her name try to purchase it in joint name, pay any money from you by cheque and try to get a Bank loan for maximum amount.

I doubt she would file case of divorce only, she may file 498 a, DV act and other cases.

I do endorse the advice of Rajender ji.

Agreed, but in given circumstances, wait for 6 months could be damaging, if she files something of the sort 498-A,DV Act etc., if flat is purchased in her name, or is purchased in your own name, would it be a guarantee for peace, I think, it can further complicate things. I think filing of an application under section 9 of Hindu Marriage Act, for restitution of conjugal affairs, and thereafter mediation through Court might solve the problem or atleast provide future safeguard for the husband.
