Registration & Stamp duty

(Querist) 23 September 2009 This query is : Resolved
Respected Sir,

As has been asked you earlier about Lease Deed, we are planning to take godowns in Hyderabad on long term lease (say 10 years period) which is extendable for further period on mutual consent.

Do we need to register the Lease Deed?

If we take the Lease Deed on bond paper and get the same signed by both the parties, will it be binding on them and valid in the Court of law?

Kindly send me your views.

Regards,

Unless it is regd., lease deed cannot be admissable as evidence in the court of law. Urs is long term lease. Hence regn., of lease deed is mandatory.riven

Pavan

In A P it is mandatory now to register a lease deed which is less than 11 months also. Since, the term is 10 years it is compulsory to register the deed within the limits of the SRO where the property is situate. As suggested by Rajeev, in case, of non registration, the deed will not be an admissible piece of evidence in the Court.riven

Agreed with AV Vishal. otherwise also it is wise step to get the lease-deed registered to avoid future misinterpretation of the deed/agreement etc.riven

It is better to register the lease deed otherwise it cannot be admissable as evidence in the court.
