Gpa for sale of flats

(Querist) 31 March 2013 This query is : Resolved
I am land owner of one of two plots, which are part of a construction agreement.
I did GPA for sale of flats in my father-in-laws name.
I do not stay in hyderabad.

Now the construction is almost complete.
I am getting 3 flats as my share.

1. How do I cancel the GPA.
2. How do I transfer the 3 flats in my name.
Devajyoti Barman (Expert) 31 March 2013
1. By a deed of revocation and subsequent paper publication.

Register cancellation deed of GPA before the same registrar wherein you had got GPA and duly intimate your brother in law with publication in news paper about the cancellation of GPA and you need to can formal partition with the co=sharer of the joint land before civil court or registrar so that you may get your separate name mutate against the 3 flats.

1.Execute and register a cancellation before same sub registrar and get the fact published in a news paper of wide circulation locally as well as nationally, also serve a registered letter
to GPA informing him about termination of GPA with thanks for his services rendered by him in cordial manner.

2.The 03 flats obtained by you are the result of the construction agreement and land you already own then builder does not need it to transfer in your name.On the basis of the construction agreement,
wherever mutation is required, you can get it register before municipality or gram panchayat etc.If co operative society is to be formed then you can claim your share certificates from the again on the basis of the construction agreement itself.

It would be builder or other's buying
flats in the share of builder under the construction agreement would require transfer sale deeds from you and not you from them. And it was that part of your act that necessitated the need of GPA in favor of your Father-in-Law.
